General Guidelines and Policies Agreed to at the Time of Purchase: The policies on this page were made to help us keep our prices low for our loyal customers, and to weed out the customers that come here for all the wrong reasons. With that being said, all sales from our website are considered completely final - we do not "rent" our security products so they can be returned to us in pieces. You have 72 hours to use and test your product and to notify us of any defects, damage, operational or shipping errors. We reserve the right to change these policies as the industry dictates, at any time, and without prior notice.
Buyer and Seller Purchase Agreement: Your use of our site (browsing) and especially your completion of our purchasing process is the equivalent of your legal "electronic signature" of approval and agreement to all of our site policies. Our system does not allow our customers to place an order until they have complied with this request. We do this to confirm that both parties understand the expectations in entering a business agreement. If, after reviewing our policies, you place your order, you are consenting to abide by our policies. We make every attempt to be fair and reasonable in our interactions. Alternate Shipping Destinations: All customers agree that they will be fully responsible for receiving their shipment and in no way will hold The Geek Factor, or affiliates, responsible for items lost, damaged, or unable to be retrieved. Furthermore, all customers fully agree that they will not hold The Geek factor or its affiliates responsible for errors made by USPS, UPS, or your local carrier to properly deliver items ordered or expected from the aforementioned. All sales are final when the purchaser reveals an intent to "resell" or give any of our products to a third party. Only direct distributors of Spy-Tronix may resell our products under a valid warranty as covered by our site policies. We do not honor most manufacturers warranties. We do however, provide replacement or refund in situations where deemed warranted by Spy-tronix as covered in the policies herein. We do our best to ship your order to the proper location requested, and we will do our best to contact you via email to clarify your shipping address; but if you do not respond to our email - we do reserve the right to ship the item to the billing address used for the order. If out of stock or unforeseen events prevent us from fulfilling your order, we will ship a partial order or cancel it entirely depending on the circumstances.
Order Cancellations: We ship fast. So if you need to cancel an order, you must quickly Contact Us to stop us from processing your order. If your order has already been processed, packed or shipped, it cannot be canceled. Cancellations cost us time and processing expenses, therefore your credit card will be charged a cancellation fee (20% of your order subtotal - shipping is non-refundable) to cover the time and fees we incur in reversing or retracting your order. If your product has shipped and you refuse delivery, you will be held responsible for the cost of shipping in both directions in addition to the 20% cancellation fee mentioned above.
Returns: All items returned to our warehouse are considered "returns." This includes packages that were shipped to the buyer and returned due to no signer, unclaimed, refused, undeliverable as addressed, etc.. The Geek Factor is not responsible for shipping errors of any kind. You may initiate a return process if authorized by The Geek Factor, LLC. You must request a Return Merchandise Authorization (RMA) code, you will then be required to fill out our RMA request form - we will provide a link to our RMA request form after our customer service team has approved your return. Your request for a return must be received within three days after receipt of your item. We will not honor requests for returns in which the merchandise has sat unclaimed for an extended period of time, or was not picked up in a timely manner as deemed by The Geek Factor. After you fill out our RMA form - we will supply you with a RMA # and full instructions for returning your merchandise to us. Items sent back to us without a valid RMA will be refused - no exceptions.
In short, (1) We reserve the right to perform minor troubleshooting, with you, for all of our products; (2) Returns must be requested to our Customer Service within 3 days of receiving your order; (3) If warranted, our Customer Service will provide you with a link to our RMA request form; (4) If approved, we'll send you an RMA # and instructions on how to return your package to us. Please ensure that the item is in its original condition (including: packaging, manuals, warranties, accessories, security seals, and shrink wrap). We must receive your returned item within 15 days of when we originally shipped it to you - or your return will be refused. Therefore, customers that let the package sit in their post office, or fail to sign for and receive it, for a prolonged period of time are not authorized for a return of any kind. Please allow us 5 - 10 business days from the time we receive the item to process your return. Abused, mishandled, damaged, or merchandise returned with missing items are not eligible for a refund and will be returned to the customer. For your protection, please obtain a tracking number for your return. The customer must pay all costs related to return shipping. After receiving and inspecting the returned merchandise, and if it is truly found to be defective, we will either exchange the item or reimburse your credit card up to $8 for the cost of re-shipping the item to us.
Non-Defective Returns: Again, we urge you to ask all question prior to purchasing from our site by using our Contact Us form; please refer to the first paragraph at the top of this page - all sales are final unless your product is defective upon receipt. Items returned, that are being claimed as defective or damaged, WILL BE SUBJECT to a 20% restocking fee if they are found to be in normal working order. Please read the manual and feel free to Contact our Customer Service for help in using your product(s).
We will not accept returns regarding certain situations. For example, but not limited to, such as the following:
- Open or used products that are not found to be "truly" defective within the first three days of use. - Fees for technical service performed or shipping to the customer of any kind - Single use products such as pepper spray - Custom built surveillance products, hidden cameras, digital video recorders (DVRs) - Counter-surveillance devices, bug detectors, rf cameras - Other select items, as noted on the product detail page. - It is understood by the buyer that all sales on the above listed items are final unless we dictate otherwise on a case-by-case basis.
Unjustified Credit Card Chargebacks: A chargeback is when a customer disputes a charge made on his/her card. If the card holder did not authorize the purchase, we will work with you and your creditor to ensure the situation is resolved properly. However, in accordance with your full agreement to our site policies at the time of your purchase, we will charge a $35 penalty fee for every unjustified credit card chargeback against our company - as well as all attempted chargebacks that we are able to reverse by defending our case. We will also report all unjustified chargebacks to ChargeBackProtection.org, thereby banning you from placing orders with any business that uses ChargeBackProtection.org.
Examples of unjustified chargebacks are: When any customer issues an unjustified or proved misleading complaint, a customer starts an unwarranted dispute with his credit card company, a customer refuses to pay, a customer ships the product without going through the RMA process and starts a dispute, a customer disregards any of our site policies after agreeing to them, a customer initiates a chargeback when they have already been refunded, and etc. In the event that a chargeback is placed on a purchase, we reserve the right to report the incident for inclusion in a chargeback abuser database. The information reported will include full name, email, order date, order amount, IP address, full address and phone number.
Buyer Remorse: Due to abuse, mis-information and less-than honest attempts at obtaining an RMA (Return Merchandise Authorization), we use the initial RMA request to determine most RMA qualifications. We do not guarantee an item will work for a customer's intended purpose but, that the item will function as advertised on our website. No buyer's remorse, and no refunds given for mistaken assumptions.
Customer service: Due to the nature of our products, all customer service is handled via email only. Only our licensed vendors, distributors, manufacturers, and our E-commerce partners have access to our phone lines. Email initiated by a customer or potential customer will usually receive a response approximately within 3 to 72 hours; all email is answered in the order it is received; for faster service, provide the billing name or order number supplied for your transaction. If we do not receive a response to our reply of any correspondence we provide you within 72 hours after it was sent, we will consider the issue(s) closed. We have the right not to answer any email or correspondence we deem suspicious in nature. Email with unrecognized names, subject matter, or contents will also be deleted by our spam filters. Customers who choose to ask last minute questions about the product in our “customer comments” box at the time of purchase will not be answered.
Using our products: By placing an order with us the customer agrees to have, hire or acquire the knowledge and skill required to follow installation instructions, operational instructions, and proper procedures for using any item purchased from our site. Our customer service is available to help you, offer tips, or to guide you through set-up with your chosen product - but we are NOT responsible (and only offer limited guidance) for computer compatibility issues, connection issues, driver installation issues, file saving and upload, etc. Proper battery installation, removal, and charging is always the basic responsibility of the purchaser.
Where we ship / Damaged shipments : Products damaged upon receipt by the customer must be proven, and confirmed, by the shipper in written form to obtain compensation from the shipper. We do not ship products to the state of Idaho or outside of the United States of America. USPS is our primary shipper - so we do ship to P.O. Boxes; we do ship to APO/FPO addresses; but we do not ship to coastal water (U.S. Territories) addresses of the U.S. A.
Promotional Offers: A buyer who purchases under a promotional offer such as, but not limited to free shipping or sale items will be subject to a full price charge on their credit card for the item(s) should they return any part of the original order. To prevent and deter fraud, there are absolutely no cash refunds (only in store credit) on these special offers which offer some sort of discount and/or product for free; these are usually are set for a limited time. Attempted Fraud: We reserve the right to decline and cancel orders that so much as hint towards the possibility of fraud. Attempted fraudulent orders will result in your IP address, and full order information, being sent to the Federal Cyber Crime Bureau, the Post Master General, local law enforcement authorities, and to your credit card provider for appropriate action; which normally results in tarnishing your credit history and profile.
Shipping Errors: You have 48 hours from the receipt of the wrong merchandise to email our customer service department and report the problem. Upon request, we will cover the cost of return shipping, not to exceed $10.00 dollars. If we do not hear from the buyer and or recipient within the proper time frame regarding an error, (Reasonable time frame discussed herein determined by Spy-Tronix Warehouse and/or its affiliates) or if Spy-Tronix warehouse does not have the merchandise in their possession, or if recipent/customer does not provide updates pertaining to wrong merchandise and its whereabouts, the credit card used in the transaction in question may be charged and/or all sales will be final. The charge may be refunded per our discretion. (i.e., missing products or items from your order).
